Terms of Service

These Terms of Service ("Terms") govern your access to and use of Kingdom of Ferrán ("the Service"), operated by the Kingdom of Ferrán team ("we," "us," or "our").

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

If you are a parent or legal guardian agreeing on behalf of a minor, you are accepting these Terms on behalf of that minor and are responsible for their compliance.

Kingdom of Ferrán is an educational entertainment platform that combines chess instruction, trivia quizzes, world exploration, and AI-assisted learning in a fantasy kingdom setting. The Service is designed primarily for children ages 5–15, with parent oversight tools available on paid plans.

Core Features Include:

• Interactive chess gameplay against AI opponents at multiple difficulty levels
• Knowledge quizzes spanning history, science, geography, and culture
• 8 themed magical worlds to explore (3 on the free tier)
• Creature companions and progression mechanics
• Lumia — an AI learning companion that adapts to the child's progress
• Voice and photo missions (Family Crown and School Realm plans)
• Parent dashboard with progress reports (paid plans)

Service Availability

We aim to maintain 99% uptime but do not guarantee uninterrupted service. Maintenance windows, updates, and events outside our control may cause temporary unavailability. We will communicate planned downtime via the home page banner when possible.

Under 13 — COPPA Compliance

Users under 13 years of age may only use the Service under the supervision of a parent or legal guardian. To create a cloud-synced account for a child under 13, the parent or guardian must:

• Create the account themselves using their own email address
• Verify their email address
• Provide verifiable parental consent as required under COPPA
• Accept these Terms on behalf of the child

Children under 13 may use the browser-based free tier (localStorage only) without any account — no personal information is collected in this mode.

Ages 13–17

Users between 13 and 17 may create their own accounts. We strongly encourage parental involvement. Parents retain the right to request access to, modification of, or deletion of their teenager's data.

Adults

Adults (18+) may use the Service and create accounts. Adults using School Realm plans on behalf of a school or organization represent that they have the authority to bind that organization to these Terms.

You agree to use Kingdom of Ferrán only for its intended educational and entertainment purposes. You agree NOT to:

• Attempt to reverse-engineer, decompile, or extract the source code of the Service
• Use automated bots, scrapers, or scripts to access or interact with the Service
• Attempt to gain unauthorized access to any account, server, or database
• Circumvent any access controls, subscription checks, or rate limits
• Submit false, misleading, or inappropriate content through any user input field
• Use the Service to harm, harass, or bully other users
• Reproduce, resell, or redistribute any content from the Service without written permission
• Use the Service for commercial purposes without our express written consent
• Attempt to disrupt, overload, or impair the functionality of the Service

Violations may result in immediate suspension or termination of your account without refund. Serious violations may be reported to law enforcement.

If you are a parent or guardian allowing a child to use Kingdom of Ferrán, you are responsible for:

• Supervising your child's use of the Service in a manner appropriate for their age
• Ensuring your child understands the rules and behaves appropriately
• Reviewing privacy and account settings in the parent dashboard
• Keeping your account credentials secure and not sharing them
• Promptly reporting any unauthorized use of your account to us
• Understanding that the AI companion (Lumia) is educational software and not a substitute for human supervision or instruction

We are not liable for any content your child encounters on third-party websites or platforms they may navigate to from links within the Service.

When you create an account, you must provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your password
• All activity that occurs under your account
• Notifying us immediately of any suspected unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms, show signs of fraudulent activity, or remain inactive for 24+ months (with advance notice).

Paid plans (Family Crown and School Realm) will be processed through Stripe, a third-party payment processor. By subscribing, you agree to Stripe's terms of service in addition to ours.

Cancellation

You may cancel your subscription at any time from the account settings. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for mid-cycle cancellations unless required by law.

Refunds

We offer a 7-day money-back guarantee on first-time subscriptions if you are not satisfied. Contact us at support@kingdomofferran.com within 7 days of your initial charge.

Price Changes

We reserve the right to change subscription prices with at least 30 days' notice to active subscribers. Founder rate pricing, where locked in at time of subscription, is exempt from price increases.

All content within Kingdom of Ferrán — including but not limited to game logic, artwork, character designs, world names, the Lumia AI character, quest narratives, music, and visual design — is the exclusive intellectual property of Kingdom of Ferrán and its creators.

You may not copy, reproduce, distribute, publicly display, or create derivative works from any Kingdom of Ferrán content without our prior written permission.

User-Generated Content

Kingdom names, in-game choices, and quiz responses submitted by users do not constitute user-generated content under copyright law. However, if we add features that allow user submissions (artwork, stories), we will update these Terms accordingly.

Feedback

If you provide feedback, suggestions, or bug reports, you grant us a perpetual, royalty-free license to use that feedback to improve the Service without any obligation to compensate you.

Kingdom of Ferrán includes AI-powered features including the Lumia companion, chess AI opponents, and cognitive learning analysis. You acknowledge that:

• AI responses are generated automatically and may occasionally be imperfect or incomplete
• AI companions are for educational entertainment — they are not therapists, tutors, or authoritative information sources
• We do not transmit personal information about children to AI providers
• AI chess opponents play according to programmatic rules and are not human
• Parents should review AI-generated learning reports and use professional educators for formal assessments

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties including but not limited to:

• Merchantability or fitness for a particular purpose
• Uninterrupted or error-free operation
• Accuracy or completeness of educational content
• Guaranteed learning outcomes from use of the Service
• Compatibility with all devices or browsers

Educational purpose only: Kingdom of Ferrán is an educational entertainment product. We make no representation that use of this Service will improve academic performance, chess ratings, or cognitive outcomes. Results will vary by child.

To the fullest extent permitted by applicable law, Kingdom of Ferrán and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising from:

• Your use of or inability to use the Service
• Unauthorized access to or alteration of your data
• Statements or conduct of any third party within the Service
• Any other matter relating to the Service

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months prior to the claim, or (b) $50 USD.

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico and the United States of America, without regard to conflict of law principles.

Informal Resolution First

Before initiating any formal legal action, you agree to contact us at legal@kingdomofferran.com and attempt to resolve the dispute informally. We will respond within 15 business days.

Jurisdiction

If informal resolution fails, any dispute shall be resolved in the courts of Puerto Rico or the applicable federal courts having jurisdiction. You consent to personal jurisdiction in these courts.

Class Action Waiver

To the extent permitted by law, you waive any right to participate in a class action lawsuit or class-wide arbitration against Kingdom of Ferrán.

We may modify these Terms from time to time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page
• Notify registered account holders via email at least 15 days before changes take effect
• Post a notice on the Kingdom of Ferrán home page

Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of those changes. If you do not agree to the updated Terms, you must stop using the Service and may close your account.
